The 2026 DEA Action on 7-OH: What Was Scheduled, and What Was Not
A factual rundown of the DEA's July 2026 notices of intent to temporarily place 7-hydroxymitragynine above a threshold, and the synthetics mitragynine pseudoindoxyl, MGM-15, and MGM-16, into Schedule I.
On July 6, 2026, the U.S. Drug Enforcement Administration published two notices of intent in the Federal Register to temporarily place several 7-hydroxymitragynine (7-OH) related substances into Schedule I of the Controlled Substances Act. Because this is a fast-moving area with real consequences for manufacturers and brands, here is a plain, sourced summary of what the action covers and what it does not.

What the notices cover
The first notice states the intent to schedule material containing 7-OH above a specified threshold, including its isomers, esters, ethers, and salts. The threshold is set at 0.05% 7-OH for the kratom plant. For material produced synthetically or derived from the plant and further processed into finished forms such as extracts, concentrates, edibles, or pressed pills, the threshold is 0.05% 7-OH or 1 milligram of 7-OH per article.
A second notice names three specific 7-OH-related synthetics: mitragynine pseudoindoxyl (MP), dihydro-7-hydroxymitragynine (MGM-15), and 9-fluoro-dihydro-7-hydroxymitragynine (MGM-16).
Per the notices, the temporary scheduling order was to be published on or after August 5, 2026, be in force on the date of publication, and remain in place for two years, with a possible one-year extension.
What the action does not target
According to the Congressional Research Service summary of the action, traditional botanical kratom leaf containing naturally occurring trace levels of 7-OH is not the target of the scheduling. The action is aimed at concentrated 7-OH above the threshold and the named semi-synthetic substances.
